The Lagos High Court in Ikeja has dismissed an application filed by Mr Joseph Aloba, father of late singer Mohbad, seeking to nullify the DPP’s legal advice that freed Naira Marley, Sam Larry, and others accused of involvement in his son’s death.
Justice Taiwo Olatokun ruled on Wednesday that the Attorney General’s powers to prosecute or not were validly exercised and could not be questioned. The court therefore refused all the reliefs sought by Aloba.
Mr Aloba, who was present in court with supporters, appeared dissatisfied with the judgment. His lawyer, Wahab Shittu (SAN), stated that they would appeal the decision.
Why Aloba Went to Court
Mr Aloba had sued the Attorney General of Lagos State and the Director of Public Prosecution (DPP), arguing that the legal advice releasing Naira Marley and Sam Larry was issued before the Coroner’s inquest concluded its findings on Mohbad’s death.
He claimed that suspects mentioned in the inquest were prematurely freed, denying the family fair hearing.
DPP’s Defence
In a counter affidavit, a legal officer from the DPP’s office explained that those released were discharged, not acquitted, as there was no evidence linking them directly or indirectly to Mohbad’s death.
The court agreed, stating there was no basis to grant Aloba’s requests.
